Your Prospective Inheritance Could be Divisible in the Family Court

A person who expects to inherit property under the will of someone who has not yet died may find that the prospective inheritance will now be taken into account in the Family Court.

Until recently the Court only took an anticipated inheritance into account in property proceedings, provided there was a high probability of the inheritance happening (for example, where the person who made the will was old, feeble and incapable of changing the will).

Recently, however, the Court has tended to take prospective inheritances into account where there is only a possibility of a party being a beneficiary.
