Trade Marks show the origin of goods or services and include well known trade names such as HYUNDAI and logos such as the four interlocking circles seen on AUDI motor vehicles or the HEINEKEN beer label. |
If you wish to register a trade mark you can apply to the Register of IP Australia. |
Trade Marks are allocated to specified classes. There are 45 categories for goods and 8 categories for services. You can apply for registration in more than one class. |
The Trade Marks Registry in the Australian Intellectual Property Office searches and examines all applications for registration of Trade Marks. If your application is rejected, you must have an opportunity to be heard. If you are rejected, you may appeal to the Federal Court. |
You may also oppose registration of a Trade Mark within the prescribed period. |
Registration lasts for ten years and may be renewed for an indefinite number of further periods of ten years. |
