Watch for Privacy
The Privacy Amendment Act ("the Act") starts on 21 December 2001 and governs collection, use, disclosure and storage of personal and sensitive information. It applies to organisations that have a turnover of more than $3m per year or are:
  • Federal Government contractors;
  • health service providers; or
  • organisations that collect or disclose personal information.
The new Act gives your customers and suppliers the right to ask the Privacy Commissioner to order you to pay damages for breaches of an individual’s privacy or to give a public apology, or to implement procedures to prevent further breaches. To avoid exposure you should immediately:
  • identify whether you are affected;
  • nominate a privacy officer to achieve compliance;
  • get legal advice on your marketing programme in connection with personal information and security;
  • conduct a privacy audit of personal and sensitive information.
