Judge blows the whistle on Refs
Construction Litigation: Judge says Expert Reference system is overloaded; Judges are now faster than Experts in hearing cases.

At a recent Directions Hearing, a Supreme Court Judge stated he was not satisfied with the number of cases that were being referred out of the Court system for an independent expert determination. The Judge stated that reference system was introduced to clear the case backlog and assist the quick and inexpensive disposal of litigated matters. However, he said that a large number of cases were being referred out for decision by referee and the reference system itself was subject to backlog. As a result, the Judge was more inclined to keep construction matters in the Court system for determination at trial before a Judge, as there were Judges available to attend a trial and reach a faster determination.
