Building Quality Legislation |
The NSW Parliament has enacted the Building Legislation (Quality of Construction) Amendment Act. It is designed to improve the quality of residential buildings by changing the building certification process, by specifying conditions to be included in residential building contracts and by changing the dispute resolution process in relation to residential building works. |
Changes to the residential building certification process |
- The principal certifying authority (PCA) can now only be appointed by the person having the benefit of the development consent - usually the owner or the owner's architect;
- The PCA now has responsibility to ensure that the building work has been properly approved, that the builder is licensed and insured, that proper inspections are made during construction and that the building complies on completion with the approved plans; and
- All residential buildings must now have a occupation certificate.

Residential building contract changes |
- All plans and specifications are to form part of the Contract;
- Variations to the Contract must be in writing; and
- All work to comply with the Building Code of Australia and the conditions of the Development Approval.

Conveyancing changes |
Contracts for sle of new residential strata units and house and land packages must not proceed to settlement until 14 days after the purchaser has been given a final occupation certificate. |
