Does sick leave accrue while the employee is on maternity leave? |
Maternity leave is a type of parental leave which is governed by the Industrial Relations Act 1996 (NSW) ("the Act"). Other types of parental leave include paternity leave and adoption leave. |
Maternity leave is leave taken by women employees during or after pregnancy, and maternity leave consists of an unbroken period of leave, of up to and no more than 52 weeks. |
As maternity leave is generally unpaid leave, an employee will need to refer to their Award, enterprise agreement, separate contract of employment or company policy, to determine whether they are entitled to benefits in addition to those provided by the Act. For example, additional benefits may include the accrual of sick leave, while on maternity leave and paid maternity leave. |
