Victorian occupational safety laws reviewed

The occupational health and safety laws in Victoria are undergoing review, for the first time in 20 years.

WorkCover Minister Rob Hulls states that Victoria will be the home to Australia's leading occupational safety and health laws. Mr Hulls said, "While the Act was groundbreaking when it was drawn up almost 20 years ago, the update is necessary to ensure that the legislation meets modern employment conditions and leads best practice."

Some of the issues to be considered include:
  • A review of penalties - their effectiveness, levels and types. Do they achieve deterrence, influence and promote health and safety outcomes?
  • A review of workplace consultations - what are the roles, rights, and duties of employee health and safety representatives?
  • A review of information - are employers aware of the legislative requirements?
  • A review of administrative support - does WorkSafe operate in a consistent and transparent manner?

Melbourne Barrister Chris Maxwell QC will be responsible for updating the occupational health and safety laws by conducting an independent report on the current status in Victoria. The Minister will be expected to receive the report early next year.
