OHS Law in NSW

From 1 September 2003, all small businesses with less than 20 employees, must comply with changes under the Occupational Health and Safety Act 2000 (the Act) and its regulations.

Introduced on 1 September 2001, the Act and Regulation granted small businesses a transition period of 2 years.

The main changes include:
  • A "duty to consult" - all employers must consult with their workers on any matters affecting the health and safety of anyone in the workplace.
     
  • Risk management processes - these must be implemented in the workplace, and include identifying the hazards, assessing the risks, eliminating or controlling the risks, and reviewing the risk assessments.
