"Pink Slip" (Continued)

The Conveyancing (Sale of Land) Regulation 2000 is to be automatically repealed under the Subordinate Legislation Act 1989, on 1 September 2005. The Conveyancing Regulations outline the obligations of vendors to disclose and attach various mandatory documents in a Contract for Sale of Land.

The Property Law Committee of the Society (perhaps during their considerations for the new 2005 edition of the Contract for Sale of Land) has noted that in other jurisdictions there is a requirement for the attachment of a Building and Compliance Inspection Report and even a Pest Inspection Report. These are optional in NSW, but they may be a good selling point for vendors. However one of the suggestions that has been mooted is to include a Certificate by a Licensed Inspector indicating the presence and condition of any asbestos materials in a property. This is as discussed in our earlier article of the 12 December 2004.
